Tallahassee Realtor ® Contract v. FR® Assumption (Jennifer Stowell, Tallahassee Realtor® member)

This is the real estate industry;
Real estate expertise is usually well regarded and valued as a *Local* Focus.

*Local* knowledge, expertise, planning..etc.

The Concern: Tallahassee Board Realtors® Existing (strengthen our current method) v. Assuming Florida Realtors® (Acquiescing/alleviating litigation & resource risk)

Why not change?

Tallahassee could possibly risk losing:

1. Authority
2. Identity
3. Control

Why Change?:

1. If TBR ® is in a position where innovation is not feasible, then delegating back to a larger ‘authority’ may be appropriate; However, it’s still risky and it will likely create more problems than it seeks to correct.

Recommendation 1: TALLAHASSEE BOARD of REALTORS ® should keep its own Contract (template) and MLS software system, administration & enforcement.

Recommendation 2: Grow membership.
If you are concerned about budget; Have insufficient resources for solving problems:

Consider further input (delay decision, if necessary) from your local members | community | leaders

How? Target those who are well-versed regarding the resources you need.

Example: Create a system in Tallahassee that is superior to the State.. Ie Tallahassee’s new*improved*unique*more user-friendly* version of ‘Form Simplicity’ and update our contract to current standards, statutes, and guidelines on a regular (annual) basis.

Recommendation 4: TBR should create & offer various training options for the Florida State Contracts.

Recommendation 5: If TBR (Members, Board) decide to adopt the state contract systems, then do it with an exception that is sufficient enough to formalize the adoption (using the minimum clauses we need/want/value) for congruency then add in our own expectations or rules, in order to finalize the process, by calling it ‘our own’ and maintaining consistency in the heading of our templates, and other signifying elements. Ultimately, keep TBR branding intact.

Final Comments:

It’s important to maintain local association control, identity & authority, especially due to the types of issues our industry faces (software decisions requiring trust, MLS/IDX Maitenance and Permission granting, data protection, security, etc).

An anti-fragile approach should be considered:

Embrace the value of municipal (local) decision-making, especially in regard to finances and law (policy); Default to larger entities (Florida Realtors/National Realtors) if and when appropriate for the specific problems that each one is best suited.
